Since it could have never been actually used as legal tender (since the demonetization occurred before the coins were sold, according to the law), I'd argue it's not a circulation coin.

​First we need define what is circulating or not.
If we agree a circulating coin is one issued to have legal tender value, then the date of demonetization is irrelevant.

From a few years ago, coins at Uruguay are issued as having legal value, and most are demonetized on the same day or prior to they be available to public. I consider them commemorative circulating coins.

Now, please note this coin https://en.numista.com/catalogue/pieces48097.html is still not demonetized, you can go to Central bank cash and ask for it, exchanging for a UYU$ 500 banknote. No receipt, nothing different to asking for small cash. If you want to give it as payment for your purchase, must be accepted for its UYU$ 500 value. BUT the cashier gives it to you in capsule, and of course, never seen one circulating; don't think anyone have done it.

All other commemorative circulating coins, that have been demonetized, you can buy them, the newer for its face value, and cashier will give receipt of sale. Older (old currencies) are priced using silver or gold value, and also USD exchange rate.

In my opinion, the issuing authority is the one who decides if a coin is valid for payments, or if is only a numismatic article, date of demonetization does not change it.

I agree if they set the coins to be demonetized immediately, they should issue them as non-circulating, I don't really know nor understand why they do things this way.
